i got married to an us citizen and igot to usa on immigrant visa 2 months ago.i got to remove the conditional state from my visa in two years but i dont think i can continue the relation any more.sir i dont want to go back to india please help me-can i hold back myself in usa after divorce.how do i apply for divorce and what will be my status of visa.

If you can demonstrate a solid reason for divorce you may have a chance. You may need to consult a good lawyer in this respect preferably who has dealt with such cases. Visit http://immigration.com and search more info as there have been cases where a few abused or battered wives have been granted.

I am a man in my 50's. My wife is younger than me and we have a 2 years beautiful daughter. After knowing each other for 14 years we are realizing that we hardly have anything in common. We get into fights quite often and fights go mostly arround the fact that my wife doesn't want to work. This is very bothersome to me, especially because I have to pay almost $1,000 a month for child care when in fact she( my wife)since she's not working anyway, she could have taking care of my daughter. I am contemplating divorce. However, I am so attached to my daughter and I don't wan't to hurt her. Anyone out there can give me an advice ?? Thank's

I have been engaged to my fiancee for 6months.I am 35 and my fiancee is 23.We both have been sleeping together so that we can get a baby but to no avail.i felt that maybe we have not done it at the right time so now,we have slept together again 4days after her menstration for about 5times but we still are not sure if she will be pregnant this time.we are both not IMPOTENT as we have seen a doctor.so,please what do we do as we are really in need to have a baby.Though,she told me that in the past years she ussed to take ANTI baby drug but for 7months now she has stoped.Do you feel that could be a cause.Also, are we being too ancious?

nowadays INS is very strange,and it is difficult to get Resident without marriage.sometimes Even After marriage he will not get Visa.why he want to marry 21 year older than him women.just for GC.i smell something BEWARE.

I am engaged to an Indian man. I am older than he is. However when we meet I thought he was older and he thought I was younger. Age was never questioned. Months later we find that there is a vast difference in our ages, 21 years. We are perfect for each other. We have spent months living together getting to know one another. My question is this. How difficult is it to get a visa for him to join me in the US? He does not want to go, but I do not want to live in India forever either.

Yes she can charge with fruad,and demand alimony too,when she was never been to that state where u got the divorce,Indian law will recognise your USA divorce and its valid,but as u married in india with rilious rites,same u have to get it from indian judiciary also before she claim something from you.

Hello legal expert:
This is for my friend. He got married in india (hindu marriage) they stayed togehter in the USA for 6months. Then the girl went back to india. The guy moved to another state for job reasons. Legally in hindu marriage act they can file for a divorce in the last place they lived (law does not say county or country or..). Guy filed for a dirove in the new state of his residence (all in usa). Is it possible for any to claim that is divorce granted to be illegal back in india or pull the guy to court on frivilous grounds.? thanks in advance for your advice. -Friend.

I was marriead in India 7 years back. We had problems in our marriage. I came to US on J1 visa last year with my daughter. My husband is still in India. I want to know whether I can apply for divorce in US & whether it will be vallid in India too. Or do I have to apply in India & while doing so, do I have to be present in the court.

Teju, if both r in States,then they can apply for divorce there, and thats valid in India too.
If its mutual then it will not take much time,thats depend on situation and demands.

My friend got married in India 1 year back. Now he and his wife are in the US and he is looking for a quick divorce. My friend is on a h1 and his wife has an h4. My questions are
1. Can he apply for a divorce in the US?
2. How much time will that process take?
3. If his wife wants to stay in the US after the divorce, what are the options before her? What does she need to do for maintaining a valid status in the US

Unfortunately being a non-immigrant visa there is no possibility of extending the stay realistically.
The only option is if h4 can change her status by applying to another non immigrant category and if it is accepted than there is a chance.

Hi,
I was married 2 and half years back. Since the day I got married, my wife tries to convince me to leave my parents and start taking care of her parents. She is not educated but just pretty. She literally has broken my home into two pieces. Physical intimacy was also few and far between. She became pregnant a year back and recently she gave birth to a baby boy. I came to USA at the time of birth. Later after the birth of the baby I received one email from my wife's brother that he was very tensed as he has found out that he has AIDS as he used to have sex regularly with my wife. He was worried that my wife and myself would be infected by the virus. After this email I am not sure if the child is mine. Please guide me. Can I get divorce with this email as a proof of her cheating. I have not got myself checked by a doctor after this email for the fear of loosing my job. Please guide me as I am really very desperate to get out of the relationship.
